How this was built
Three TxDOT bid contracts were analyzed by Clarement:
- Lubbock District longline striping and traffic control devices, CSJ 0905-00-127, Lubbock District, various highways
- Truck Parking Availability System, ITS equipment installation, CSJ 0924-00-168, El Paso District, various locations along I-10
- SL 88 roadway widening, CSJ 1502-01-031, Lubbock County, new frontage lanes, an overpass, and two direct-connect bridges
Clarement's AI analyzed the complete bid package for each of these three projects, special provisions, general notes, the contract itself, and the drawings, not just a summary sheet, to identify risks that can affect a project during execution. Those risks were categorized using a fixed taxonomy. Here's how the six categories covered in this guide broke down:
These same patterns, restricted work hours, weather-driven placement limits, off-right-of-way material storage requirements, and other construction-methodology restrictions like monolithic pour prohibitions, also show up when this same kind of review is applied to TxDOT contracts outside this dataset. Detailed below, in order of frequency.
TxDOT construction risks in 6 categories
Utilities coordination: 23 findings, the largest category
SL 88 and the ITS project both tie grounding work to the same external standard. SL 88:
"Grounding conductors that share the same conduit, junction box, ground box or structure shall be bonded together at every accessible point in accordance with the electrical detail sheets (ED), and the latest edition of the National Electrical Code."
The ITS contract, the same requirement:
"At every accessible point, bond together the grounding conductors that share the same conduit, junction box, ground box, or structure in accordance with the electrical detail sheets and the latest edition of the National Electrical Code."
Utility damage on the ITS project comes with a hard clock:
"In the event that any part of the existing underground utilities are damaged during construction, the contractor will repair or replace the damaged equipment within 24 hours at no cost to the Department."
And energizing anything runs on the utility's schedule, not yours. SL 88:
"Secure a permit for electrical service from South Plains Electric Co-Op (SPEC). Coordinate with SPEC during the first three weeks of the project lead-time period allowing adequate time for any necessary utility adjustments, transformer installation, etc."
The ITS contract puts an even longer number on it:
"Meet at the service locations with representatives of the Department, and electrical utility company at least twelve weeks before electric power is needed to finalize exact service pole placement and resolve any issues."
Impact. This is the largest category here for a reason. Utility work runs on other parties' timelines, permits, locates, coordination meetings measured in weeks, not days, and a strike or a damaged line becomes your emergency regardless of fault, on a clock as short as 24 hours.
Traffic control: 16 findings
Both the striping and ITS contracts gate the whole job behind the same approval step. The striping contract:
"Item 502 - Barricades, Signs, and Traffic Handling. Prior to beginning construction, the Engineer shall approve the routing of traffic and sequence of work."
The ITS contract, the same gate, one word different:
"Item 502 – Barricades, Signs, and Traffic Handling. Prior to beginning construction, the Engineer will approve the routing of traffic and sequence of work."
The striping contract makes traffic control the contractor's problem regardless of what's on the plans:
"All bid items and work requiring traffic control is the responsibility of the contractor, even when not explicitly detailed in the plans. Consider this work subsidiary to Item 502."
On the ITS project, law enforcement support comes with real cost gaps:
"No payment will be made for law enforcement personnel needed for moving equipment or payment for drive time to/from the event site. Minimums, scheduling fees, etc. will not be paid; TxDOT will consider paying cancellation fees on a case-by-case basis."
And any sequence change you want carries its own liability:
"Any approved change to the sequence of work or TCP, must be signed and sealed by a Contractor's Licensed Professional Engineer assuming full responsibility for any additional barricade signs and devices needed."
Impact. Traffic control cost and schedule risk sits almost entirely with the contractor: extra devices, weather-driven maintenance, and law-enforcement support are frequently unpaid or capped, and any sequence change you propose can require your own PE's stamp before it's usable.
Waste & site cleanup: 14 findings
SL 88 and the striping contract both require the site cleared daily, not just at the end of the job. SL 88:
"At the end of each day remove from the ROW, inside or outside the project limits, any excess material and debris resulting from construction."
The striping contract, the same core requirement, with paperwork attached:
"At the end of each day remove from the ROW, inside or outside the project limits, any excess material and debris resulting from construction. Correct any deficiencies identified during the final inspection including required paperwork."
Both contracts also carry the same dumpster requirement. SL 88:
"Provide a lidded dumpster to be used by Contractor's personnel on the job site. The lid or covering to the dumpsters needs to be able to stay closed in high winds to prevent trash from being blown out. This shall be considered subsidiary to the various bid items."
And final cleanup on SL 88 is a real precondition, not a courtesy:
"Upon completion of the work, remove construction project litter, debris, objectionable material, temporary structures, excess materials, and equipment from the work locations. Clean and restore property damaged by the Contractor's operations during the prosecution of the work. The work performed under this Article will not be paid for directly, but will be subsidiary to Items of the Contract."
Impact. Cleanup obligations are almost always subsidiary, the cost is priced into other items rather than paid directly, and final cleanup specifically can sit between your crew and final acceptance, so it's rarely optional even at the very end of a job.
Working hours restrictions: 11 findings
The SL 88 widening project and the striping contract carry nearly identical language on when work is actually allowed to happen. SL 88:
"Do not begin work before sunrise or end work after sunset unless authorized by the Engineer and remove all equipment from the roadway before sundown."
The striping contract, the same restriction almost word for word:
"Do not begin work before sunrise or end work after sunset unless authorized by the Engineer, and remove all equipment from the roadway before sundown."
SL 88 stacks specific hour windows on top of that general rule:
"Paving operations will only be allowed between the hours of 9PM and 6AM, Sunday through Thursday. Work that interferes with traffic is required to be performed during off-peak hours, 6 pm to 7 am."
And adds six mandatory shutdown dates:
"Shut down operations the working day before the following major traffic generating holidays: January 1st (New Year's); Last Monday in May (Memorial Day); July 4th (Independence Day); First Monday in September (Labor Day); Fourth Thursday in November (Thanksgiving); and December 24th (Christmas Eve)."
Working-day charging doesn't wait for a full day either:
"Working days will be charged Monday–Friday, excluding national or State holidays, if weather or other conditions permit the performance of the principal unit of work underway... for a continuous period of at least 7 hr. between 7:00 A.M. and 6:00 P.M."
Impact. Narrow work windows, night-only paving, off-peak-only work near traffic, sunrise-to-sunset limits, plus six mandatory holiday shutdowns, compress how many genuinely productive hours you get. And working-day charges can still accrue on a 7-hour threshold even on a day your crew never got full access to the site.
Temporary works: 10 findings
SL 88 puts real engineering responsibility on temporary structures, not just labor. On cofferdams:
"Provide a coffer dam for structures in playa lakes so the water may be pumped out and work resumed after a rain event."
And on shoring specifically:
"The Contractor and/or Contractor's Engineer who selects and designs the temporary shoring is responsible for the overall (global) stability calculations as well as internal stability and sliding calculations... Designs for any type of Retaining Wall used for Temporary Special Shoring shall conform to the TxDOT Geotechnical Manual Chapter 6: Retaining Walls."
On the ITS project, temporary protection shows up as a daily, recurring obligation instead of a one-time design task:
"Cover drilled shafts with plywood and delineate with pedestrian fence, to the satisfaction of the Engineer, when no work is being performed and after working hours. This work shall be considered subsidiary to this item. Remove spoils, daily, out of the drainage areas or as directed."
Impact. Most temporary works, shoring design, cofferdams, drilled shaft protection, carry real engineering and stability responsibility, and the cost of maintaining them, or restoring the ground once they're gone, is frequently subsidiary, meaning it's priced into another bid item rather than paid for on its own.
Material storage & custody: 7 findings
SL 88 puts real handling responsibility on material the moment it changes hands:
"The Contractor shall transport and haul the materials from the facility address of 135 Slaton Road Lubbock, Texas, 79404-5201 to the project site, including all associated loading, securing, transport, unloading, and handling. The Contractor shall verify quantities and condition of all equipment at time of pickup. The Contractor shall assume all responsibilities for the materials once they are removed from the Department facility."
Salvaged material comes with its own logistics and ownership terms:
"Salvage 75% of the Flex Base, haul, and place into stockpiles at the following locations... Any remaining salvaged flex base shall become the property of the contractor."
And large stockpiles carry ongoing site-management obligations:
"Stockpile an estimated 86,000 CY of excess excavated material at the intersection of FM 1585 and Upland Ave. as directed. Maintain drainage."
The striping contract adds a public-facing angle the other two don't: on-site material and waste storage has to be temporary, follow a removal schedule the project engineer approves, and align with the TCEQ Construction General Permit's housekeeping requirements, not just TxDOT's own rules.
Impact. Once material leaves a TxDOT facility, or gets salvaged off the roadway, custody and condition become your responsibility immediately. Stockpile drainage, barricades, and documentation can gate whether you actually get paid for material you've already handled.

Why do these six categories keep showing up on different kinds of TxDOT jobs?
Because they come from TxDOT's standard contract provisions and specifications, not from any one project's unique scope. A striping job and a bridge job draw on a lot of the same underlying contract language, even where their specific triggers, drilled shafts versus railroad crossings, for instance, differ.
What does severity mean here, and how is it scored?
Each finding is scored on likely impact and likelihood of occurring, categorized as low, medium, high, or critical. It reflects the risk as written in the contract, not a prediction about any specific project's outcome.
What happens if a risk analysis can't fully verify every required field?
It's marked incomplete rather than filled in with an assumption, so you know a field like a payment-days figure or an LD cap wasn't clearly stated in the contract, instead of getting a confident-looking number that isn't actually backed by the text.
Which of these risks should actually change how I staff or schedule a project, not just how I price it?
Utilities coordination and traffic control are the two most likely to affect your actual schedule and crew assignments, both run on lead times and approvals outside your control. Working hours and temporary works affect production rate and crew planning more than they affect price. Waste cleanup and material custody are closer to routine, budget for them, but they rarely change how you staff a job.
Do these risks scale the same way on a small project as a large one?
Not necessarily. A holiday shutdown list or a 24-hour utility repair clock applies the same way regardless of contract size, but categories tied to volume, stockpile management, salvage logistics, cleanup frequency, scale with how much material and how many crew-days are actually on site.
How often is this updated as more contracts are analyzed?
